Uncontested Divorce vs. Contested Divorce

Uncontested Divorce means that you and your spouse are in agreement on division of assets and child custody and support. The process is straightforward, though it may be complicated by the complexity of your finances and ability to come to an agreement on all of the issues. We assist our clients through the entire process, including filing documents with the court. We are compassionate and knowledgeable, available by phone and email throughout the entire process to answer questions and keep your divorce moving forward. We offer mediation to help both parties come to a mutually agreed upon conclusion. You can begin the process for a divorce by giving A Golden Legal Service a call at 510-571-7860. We can help whether the matter is uncontested or contested. Whether a dissolution of marriage is contested or uncontested depends on the parties themselves. If the parties are able to agree upon all issues concerning the divorce, such as custody and support of any children born of the marriage and division of the material assets and liabilities, the divorce will be uncontested. However, if the parties cannot reach an agreement as to such issues, the proceeding is considered contested. There is a difference in the cost, extent, and formality in contested and uncontested divorces. A contested divorce will usually cost more in expenses and attorney fees, and will require a formal court trial to determine the issues of child custody, support and the division of marital property. Whether your matter is contested we can help you get through the process. If your situation rises to the level of requiring legal advise we work with experienced and affordable family law attorneys.
